Abstract

This study examined a child’s views in the award of child custody in Nigeria. The article intends to bring to fore the importance of giving consideration to the views of a child by the court during divorce proceedings in Nigeria. The study found that the guiding principle for the award of child custody in Nigeria is the “best interest” of the child. The opinion of a child whose interest is to be protected is not always heard. Rather it is the conflicting interests of parents that usually override the views of the child. The study concluded that the views of a child is a relevant consideration in the award of child custody during divorce proceedings in Nigeria.
