RETHINKING THE EFFECTIVENESS OF STATUTORY RESOURCE ALLOCATION TO DRIVE SUSTAINABLE DEVELOPMENT IN NIGERIA

Abstract

This study evaluates the effectiveness of the Host Community Development Trust (HCDT) created under Chapter 3 of the Petroleum Industry Act, 2021 as a tool for sustainable growth in Nigeria’s oil-producing areas. In the past, the Niger Delta suffered from great mismanagement of natural resources. It heavily relied on international oil companies who did this voluntarily and through Global Memorandum of Understanding (GMoU). However, this method was faulty hence leading to issues which led to the establishment of the HCDT. The PIA represents a noteworthy legislative change by requiring oil companies ("settlors") to contribute 3% of their actual operating expenditures (OpEx) annually into legally established trusts. This study conducts a doctrinal analysis of the structural improvements in this new regulatory framework, focusing on the 75/20/5 financial partitioning model, and evaluates the ongoing obstacles obstructing its implementation. Results indicate that although the HCDT framework offers a unique legal basis for community development, its effectiveness is presently hindered by internal governance issues like elite capture, boundary disputes between communities, and the contentious liability clauses in Section 257(2). The study further looks at how recent onshore asset sales by international Oil companies affect the status of the HCDT and its implications on the Host Communities. The study finds that for the HCDT to succeed, it requires more than legal framework. It requires strict regulatory enforcement, independent financial reviews and involvement of the community.
